Introduction

This Privacy Policy outlines Integrity Engineering’s ongoing obligations to you in respect of how we manage your Personal Information. Where the words ‘we’, ‘us’ or ‘our’ have been used, they refer to Integrity Engineering ABN 18 007 806 626.

Our Privacy Policy

Integrity Engineering has opted to be covered by the Federal Privacy Act (1988) and it’s National Privacy Principles (NPPs) which set out standards for the collection, use, disclosure, storage, securement and disposal of Personal Information.

Personal Information is essentially information or an opinion about a living individual whose identity is apparent or can reasonably be ascertained from the information or opinion (e.g. a name or address).

Our Privacy Policy applies to any Personal Information we collect, use or disclose after 21 December 2001. It does not apply to our employee records.

A copy of the National Privacy Principles may be obtained from the website of The Office of the Federal Privacy Commissioner at www.privacy.gov.au. We are listed on the Opt-In Register available at that website.

How and Why We Collect Personal Information

We collect Personal Information for the primary purpose of providing our services to you, arranging the services of others on your behalf and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure.

We collect Personal Information either directly from the relevant individuals or indirectly from third parties. For example, a strata manager may not only provide us with information on themselves for the purpose of obtaining our services but also members of the Strata Corporation who they represent. We may also obtain Personal Information from contractors, builders and like persons who have had previous, existing or proposed dealings relating to the project we are undertaking on your behalf.

We also use the Personal Information gained to help to identify and develop services that may interest clients, conduct market or customer satisfaction research, and circulate promotional or technical correspondence. You may unsubscribe from our mailing/marketing lists at any time; all you need to do is let us know.

The type of Personal Information we collect generally includes your name, address, email address, phone number and other information specific to the service we are offering. This Personal Information may be obtained in many ways including interviews, correspondence, by telephone, by email, via our website www.ieng.com.au and from third parties.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information

In certain circumstances we may also collect information which is sensitive. Sensitive information is defined in the Privacy Act as information or opinions about such things as an individual’s racial or ethnic origin, religious or philosophical beliefs, membership of a political association, membership of professional or trade organisation, criminal record or health information. Unless the sensitive information is required or permitted by or under law, we will obtain your consent to its collection.

Sensitive information will be used by us only for the primary purpose for which it was obtained; for a secondary purpose that is directly related to the primary purpose; with your consent; or where required or authorised by law.

How We Use and Disclose Personal Information

We do not use or disclose Personal Information for any purpose that is unrelated to our services and that you would not reasonably expect (except with your consent).

We have a duty to maintain the confidentiality of our clients’ affairs, including Personal Information. Our duty of confidentiality applies except where disclosure of your personal information is with your consent or compelled by law.

We usually disclose Personal Information to third parties who assist us or are involved in the provision of our services. You authorise us to disclose necessary information to any agents or contractors who provide services to us in connection with the provision of products or services you have sought from us. For example, in undertaking a building assessment we may provide information to independent testing contractors, local regulatory authorities and product suppliers involved in the project works. These parties are prohibited from using your Personal Information except for the specific purpose for which we supply it to them.

If the required Personal Information is not provided, we or any involved third parties may not be able to provide appropriate services.

What We Expect of You and Third Parties We Deal With

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take all reasonable steps to ensure that you are made aware of the information provided to us by such third party.

When you provide us with information about other individuals, we rely on you to have made them aware that you will or may provide their information to us, the purpose we use it for, the types of third parties we disclose it to and how they can access it (as described in this document). If it is sensitive information we rely on you to have obtained their consent to the above. If you have not done either of these things, you must tell us before you provide the relevant information.

If we give you Personal Information, you must only use it for the purposes we agreed to. Where relevant, you must meet the requirements of the National Privacy Principles set out in the Privacy Act 1998 when collecting, using, disclosing and handling Personal Information on our behalf. You must also ensure that your agents, employees and contractors meet the above requirements.

Security of Personal Information

We endeavour to protect any Personal Information that we hold from misuse and loss, and to protect it from unauthorised access, modification and disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

Access to your Personal Information

You have the right to access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please make out your request to us in writing.

Integrity Engineering will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing such information.

Maintaining the Quality of your Personal Information

It is an important part of providing our services to you that your Personal Information is up to date. The National Privacy Principles require that we take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date.

It is important that you advise us at the earliest opportunity of any changes to your Personal Information so that our records can be updated.

Transfer of Information Overseas

In the unlikely event that it is necessary to transfer your Personal Information overseas to provide our service, it will only be done with your explicit consent.

Sale or Restructure of Business

In the future we may consider the sale or restructure of our business or the purchase of the business of other structural engineering or building inspection consultancies. In such circumstances it may be necessary for your Personal Information to be disclosed to permit the parties to assess the sale or restructure proposal for example through a due diligence process.

We will only disclose such of your Personal Information as is necessary for the assessment of any sale or restructure proposal and subject to appropriate procedures to maintain the confidentiality and security of your Personal Information. The parties to whom such Personal Information is disclosed are prohibited from using your Personal Information except for the specific purpose for which we supply it to them. In the event that a sale or restructure proceeds, we will advise you accordingly.

Opting Out

If we send you any information about our services, or you do not want us to disclose your personal information to any other organisation required for us to perform our services appropriately, you can opt out by calling our Company Director on (08) 9258 9261 or emailing projects@ieng.com.au.

Our Website

You are able to visit our website without providing any personal information. We will only collect personal information with your prior knowledge. Email addresses are only collected if you send us a message and will not be automatically added to a mailing list.

We do not guarantee the integrity or privacy policy of externally linked websites.

Cookies

A cookie is a small string of information that a website transfers to your browser for identification purposes. The cookies we use may identify individual users.

  • Cookies can either be “persistent” or “session” based.
  • Persistent cookies are stored on your computer, contain an expiration date, and are mainly for the user’s convenience.

This Privacy Policy may change from time to time. The current Integrity Engineering Privacy Policy is available on our website or via email or post on request.

Privacy Complaints

If you ever have a need to make a complaint we will endeavour to respond as soon as possible and will try to resolve any complaint. If this is not possible, we will contact you to let you know how long we estimate that it will take to resolve your complaint. If the complaint remains unresolved after twenty (20) working days we will assist you in referring the matter to the Privacy Commissioner.
